Terms of Service

1. Acceptance of Terms

By accessing or using CalWu ("the Service"), operated by Cal With U ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CalWu is a scheduling platform that enables users to create booking pages, manage appointments, integrate with calendars, and communicate with clients through AI-powered scheduling tools. The Service includes web-based booking pages, an embeddable widget, an AI chat assistant, and an email scheduling assistant.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Use automated means to access the Service except through our published APIs
  • Transmit spam, unsolicited communications, or malicious content
  • Attempt to manipulate or abuse the AI assistant for purposes other than scheduling

5. Data and Content

You retain ownership of all data you provide to the Service. By using CalWu, you grant us a limited license to process, store, and transmit your data solely for the purpose of providing the Service. We will not sell your data to third parties.

6. Calendar Integration

When you connect third-party calendar services (Google Calendar, Microsoft Calendar), you authorize CalWu to read and write calendar events on your behalf. You may revoke this access at any time through the Integrations settings or through the third-party provider.

7. Payments

Certain features may require payment. Payments are processed through Stripe. By providing payment information, you authorize us to charge the applicable fees. All fees are non-refundable except as required by law or as explicitly stated.

8. AI-Powered Features

CalWu uses AI (powered by Anthropic Claude) for the chat widget and email assistant. While we strive for accuracy, AI-generated responses may occasionally contain errors. The AI assistant is designed solely for scheduling purposes and includes guardrails to prevent misuse. We are not liable for any incorrect information provided by the AI assistant.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice when possible.

10. Termination

You may delete your account at any time through the Settings page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by law, CalWu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CalWu and its officers, employees, and agents from any claims arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
